These Terms of Service ("Terms") govern your access to and use of Garden Navi, a gardening software application available at app.gardennavi.com and the website gardennavi.com (together, the "Service"). The Service is operated by M&N Consulting, LLC, doing business as Garden Navi ("Garden Navi," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that the information you provide is accurate.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly at clientcare@leadkast.com if you suspect unauthorized use. You may not share your account or use another person's account without permission.
Garden Navi offers a 30-day free trial that does not require a credit card at sign-up. At the end of the trial, continued full access requires a paid subscription of $9.95 per month or $99 per year, as selected at checkout. Prices are in U.S. dollars and may change with notice for future billing periods.
Read-only access. If your trial ends without a paid subscription, or if you cancel and your paid period expires, your account moves to a read-only state. Your data remains stored and viewable, but you will not be able to add, edit, or delete entries until you subscribe or reactivate.
Paid subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time from your account profile. When you cancel, you keep full access until the end of your current paid period, after which the account becomes read-only. Refunds are governed by our Refund Policy.
You agree not to:
You retain ownership of the content you submit, including plant records, journal entries, photos, and community posts ("User Content"). You grant Garden Navi a non-exclusive, worldwide license to store, display, and process your User Content solely to operate and improve the Service. You are responsible for your User Content and confirm you have the rights to share anything you upload.
The Service includes community areas where users can post and reply. You are solely responsible for what you post. We may remove content or suspend accounts that violate these Terms or our community guidelines, at our discretion and without prior notice.
Garden Navi provides gardening guidance, frost estimates, and planting suggestions for informational purposes only. This information is not guaranteed to be accurate for your specific location or conditions. See our Disclaimer for details. You are responsible for your own gardening decisions.
The Service, including its software, design, logos, and content we create, is owned by M&N Consulting, LLC and protected by intellectual property laws. These Terms do not grant you any right to our trademarks or branding.
We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. You may stop using the Service at any time. Upon termination, provisions that by their nature should survive will continue to apply.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, M&N Consulting, LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or crops, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the twelve months before the claim.
You agree to indemnify and hold harmless M&N Consulting, LLC from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.
We may update these Terms from time to time. When we do, we will revise the effective date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Tennessee.
